Terms and Conditions

Welcome to Brown's Pharmacy. These Terms and Conditions constitute a legally binding agreement between you and Brown's Pharmacy regarding your use of brownspharmacy.co.ke and the purchase of any pharmaceutical or diagnostic services.

1. Professional Pharmacy Services

Brown's Pharmacy is a licensed entity under the Pharmacy and Poisons Act (Cap 244). All medications are dispensed by qualified, licensed pharmacists. By using this site, you acknowledge that the information provided is for educational purposes and does not replace professional medical advice, diagnosis, or treatment from your doctor.

2. Prescription Medication Policy

Strict protocols apply to all Prescription-Only Medicines (POM):

• ● Validation: We will not dispense POMs without a valid, legible prescription from a registered medical practitioner.
• ● Verification: Our pharmacists reserve the right to contact your doctor to verify the authenticity of a prescription.
• ● Originals: In compliance with PPB regulations, the original physical prescription must be presented to our rider or at our premises upon delivery/collection of certain controlled schedules.

3. No-Return and Refund Policy for Medicines

Due to health and safety regulations in Kenya, medicines cannot be returned or exchanged once they have left the pharmacy premises. This is to ensure the integrity and storage conditions of the medication are never compromised. We only offer refunds or replacements if:

• The product delivered is expired.
• The product was damaged during transit.
• The incorrect item was dispensed due to our error.

4. Delivery and Logistics

We aim for 30-minute to 3-hour delivery within Nairobi. However, delivery times are estimates and may be affected by traffic, weather, or prescription verification delays. We are not liable for delays caused by third-party courier services or incorrect address information provided by the user.

5. Lab Diagnostics (Dr. Kalebi Labs)

Diagnostic services booked through our Site are performed in partnership with Dr. Kalebi Labs. We act as a collection and facilitation point. The accuracy and clinical interpretation of results are the responsibility of the laboratory and your primary healthcare provider.

6. Payment and Pricing

Prices are inclusive of VAT where applicable and are subject to change without notice. Orders are only processed once payment (M-Pesa or Card) is confirmed. In the event of a pricing error on the Site, we reserve the right to cancel the order and issue a full refund.

7. Limitation of Liability

Brown's Pharmacy shall not be liable for any indirect, incidental, or consequential damages arising from the use of products purchased through our Site. Users must read all labels and package inserts carefully before use.
